Terms and Conditions
1. Scope
These Terms and Conditions apply to all orders placed by consumers or businesses through the online shop HOUSE OF AKIR.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
2. Contractual Partner and Conclusion of Contract
The purchase contract is concluded with HOUSE OF AKIR.
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the button “Buy now”, you submit a binding offer to purchase the selected products.
The contract is concluded once you receive an order confirmation by email.
3. Made-to-Order Products
All products are made to order. Production begins only after payment has been received.
As each item is handcrafted, minor variations in color, shape, or texture may occur. Such variations are inherent to the handmade process and do not constitute a defect.
4. Prices and Payment
All prices are stated in euros and include statutory VAT where applicable.
Available payment methods are displayed during checkout.
The purchase price is due immediately upon conclusion of the contract.
5. Delivery and Shipping
Delivery is available within Germany and the European Union. Shipping to countries outside the EU is possible upon request only.
Delivery times begin after payment has been received.
You will receive a confirmation email with the estimated delivery timeframe for your made-to-order item.
All shipments are sent via insured shipping providers with tracking.
Shipping is free for orders over €400.
6. Right of Withdrawal
Consumers generally have a statutory right of withdrawal.
Exclusion of the Right of Withdrawal:
The right of withdrawal does not apply to contracts for the delivery of goods
-
that are not prefabricated and
-
for which an individual selection or determination by the consumer is decisive, or
-
which are clearly tailored to the personal needs of the consumer
(§ 312g para. 2 no. 1 German Civil Code – BGB).
As all products are made to order, the right of withdrawal is excluded insofar as the statutory requirements are met.
7. Retention of Title
The goods remain our property until full payment has been made.
8. Warranty
Statutory warranty rights apply.
Due to the handmade nature of the products, minor deviations are possible and do not constitute a defect, provided they do not significantly impair the product’s usability or value.
9. Liability
We are liable without limitation in cases of intent and gross negligence.
In cases of slight negligence, we are liable only for breaches of essential contractual obligations and limited to foreseeable, typical damages.
Liability for injury to life, body, or health remains unaffected.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged and do not participate in dispute resolution proceedings before a consumer arbitration board.
